Settlement Offer
The following terms constitute my final settlement offer:
- Monetary Compensation:
- $10,000, contingent upon the restoration of my UpWork Job Success Score (JSS) to 100%.
- $24,000, if UpWork does not restore my JSS to a perfect 100% within 90 days, even after the deletion or revision of negative reviews.
- Mutual Release of Claims:
- Both parties agree to a full and final release of any and all claims arising from this dispute.
- Mutual Removal of Negative Reviews on UpWork:
- Both parties shall remove or revise any negative reviews posted on UpWork to reflect a neutral or positive resolution.
- Mutual Non-Disparagement Agreement:
- Both parties agree to refrain from making any disparaging remarks about one another in any public or private forum.
- Mutual Good Faith Compliance with Settlement Terms:
- Both parties shall act in good faith in executing and upholding the terms of the settlement.
- Tax Liability Assumed by Verdant Strategies:
- Verdant Strategies shall assume any tax penalties or liabilities arising from this settlement, ensuring that the Contractor is not responsible for any tax-related burdens resulting from Verdant Strategies’ prior misclassification.
- Acknowledgment of Fair Compensation:
- Both parties acknowledge and agree that this settlement does not constitute a benefit in excess of what the Contractor is otherwise entitled to receive, but rather a fair resolution of the matter arising from a misunderstanding.
- Option to Discuss Confidentiality Regarding Public Documentation of This Case:
- I maintain the right to publish this experience as a legal case study on my law blog, where I document my legal journey, particularly regarding contract law, independent contractor misclassification, wrongful termination, and employer retaliation.
- However, I am open to discussing a confidentiality provision regarding publication, should Verdant Strategies wish to negotiate terms for keeping this matter private.
- If Verdant Strategies requests confidentiality, an additional financial consideration will need to be negotiated to account for the loss of my ability to publish and leverage this case as an educational and professional resource.
